Sehr geehrte Frau Dr. Hoang Thi My Lam,

vielen Dank für Ihr Schreiben vom 12.Juli 2020 im Namen von 68

Organisationen der vietnamesischen Diaspora, in dem Sie das Vorgehen Chinas im Südchinesischen Meer ansprechen. Die Präsidentin hat mich gebeten, Ihnen in ihrem Namen zu antworten.

Die Europäische Union hat wiederholt erklärt, dass einseitige Maßnahmen im Südchinesischen Meer zu einer Eskalation der Spannungen und einer Verschlechterung der regionalen maritimen Sicherheitslage führen und somit eine ernsthafte Bedrohung für die friedliche Entwicklung der Region darstellen. In der derzeitigen, von der COVID-19-Pandemie geprägten Situation ist dies um so mehr von Bedeutung.

Die Europäische Union setzt sich für Frieden und Sicherheit in Asien, einschließlich des Südchinesischen Meeres, sowie für die Zusammenarbeit im Bereich der maritimen Sicherheit ein und fordert alle Seiten in der Region konsequent auf, Zurückhaltung zu üben und Streitigkeiten im Einklang mit dem Völkerrecht, insbesondere dem Seerechtsübereinkommen der Vereinten Nationen (SRÜ), friedlich beizulegen

Im Interesse der Stabilität in der Region fordert die EU alle Seiten nachdrücklich auf, von der Androhung oder Anwendung von Gewalt und von jeglichen Provokationen abzusehen, die die Spannungen in der Region weiter verschärfen würden. Alle Staaten müssen in der Lage sein, ihre Rechte im Einklang mit dem Völkerrecht auszuüben.

Wir nehmen Ihr Referendum und Ihre Besorgnis über die Meinungsfreiheit in Vietnam zur Kenntnis. In dieser Hinsicht setzt sich die Europäische Union nachdrücklich dafür ein, sicherzustellen, dass die Menschenrechte, einschließlich der Meinungsfreiheit, weltweit und insbesondere in Vietnam gewahrt werden. Dies geschieht durch konkrete Unterstützung einzelner Menschenrechtsverteidigerinnen und -verteidiger und Nichtregierungsorganisationen, aber auch durch die Aufnahme eines offenen und direkten Dialogs mit den vietnamesischen Behörden.

Das Freihandelsabkommen würde uns zusätzliche Instrumente geben, um eine engere Zusammenarbeit mit Vietnam zu verfolgen und weitere Fortschritte im Bereich der Menschenrechte zu erzielen, wobei der Schwerpunkt auf Arbeitnehmerrechten, mehr Transparenz und Rechtsstaatlichkeit, einer engeren Interaktion mit der Zivilgesellschaft durch die Einrichtung interner Beratungsgruppen sowie der Schaffung weiterer Kanäle für die Zusammenarbeit mit den vietnamesischen Behörden liegen würde.

Die EU wird die Lage von Menschenrechtsverteidigerinnen und -verteidigern weiterhin aufmerksam beobachten und Einzelfälle ebenso wie Bedenken im Zusammenhang mit der Meinungsfreiheit im Rahmen ihrer Beziehungen zu Vietnam konsequent zur Sprache bringen.

Dear Ms Dr. Hoang Thi My Lam,

Thank you for your letter of July 12, 2020 on behalf of 68 Organizations of the Vietnamese diaspora in which you talk about China’s actions in the South China Sea. The President asked me to answer you on her behalf.

The European Union has repeatedly stated that unilateral action in the South China Sea is escalating tensions and worsening regional maritime security, posing a serious threat to the peaceful development of the region. In the current situation marked by the COVID-19 pandemic, make this problem  more important.

The European Union is committed to peace and security in Asia, including the South China Sea, as well as for cooperation in the field of maritime security and

consistently calls on all sides in the region to exercise restraint and to settle disputes peacefully in accordance with international law, in particular the United Nations Convention on the Law of the Sea (UNCLOS).

In the interests of stability in the region, the EU urges all sides to refrain from threats or use of force and from any provocation that would further exacerbate tensions in the region. All states must be able to exercise their rights in accordance with international law.

We take note of your referendum and concerns about freedom of expression in Vietnam. In this regard, the European Union is committed to ensuring that human rights, including freedom of expression, are respected worldwide, and particularly in Vietnam. This is done through concrete support of individual human rights defenders and non-governmental organizations, but also through the establishment of an open and direct dialogue with the Vietnamese authorities.

The free trade agreement would give us additional tools to pursue closer cooperation with Vietnam and to make further progress in the area of ​​human rights, with a focus on workers’ rights, more transparency and the rule of law as well as with the emphasis on closer interaction with civil society through the establishment of internal advisory groups and further channels for cooperation with the Vietnamese authorities.

The EU will continue to closely monitor the situation of human rights defenders and will consistently raise individual cases and concerns about freedom of expression in its relations with Vietnam.

Chúng tôi cảm ơn bà về lá thư ngày 12 tháng 7 năm 2020 thay mặt 68

tổ chức của cộng đồng người Việt hải ngoại mà trong đó bà đã nêu lên hành động của Trung Quốc ở Biển Đông. Bà Chủ Tịch Ủy Ban Liên Âu yêu cầu tôi nhân danh bà ấy trả lời bà.

Liên minh châu Âu đã nhiều lần tuyên bố rằng hành động đơn phương ở Biển Đông đang làm leo thang căng thẳng và làm xấu đi an ninh hàng hải khu vực, đe dọa nghiêm trọng đến sự phát triển hòa bình của khu vực. Trong tình hình hiện tại được đánh dấu bởi đại dịch COVID-19 khiến điều này càngcó ý nghĩa nhiều hơn nữa.

Liên minh châu Âu luôn dấn thân vì hòa bình và an ninh ở châu Á, bao gồm cả Biển Đông, cũng như hợp tác trong lĩnh vực an ninh hàng hải và khẩn thiết kêu gọi tất cả các bên trong khu vực thực hiện kiềm chế và giải quyết tranh chấp một cách ôn hòa phù hợp với luật pháp quốc tế, đặc biệt là Công ước Liên hợp quốc về Luật Biển (UNCLOS).

Chúng tôi lưu ý đến cuộc trưng cầu dân ý và những lo ngại của bà về quyền tự do ngôn luận ở Việt Nam. Về vấn đề này, Liên minh Châu Âu cam kết bảo đảm rằng các quyền con người, bao gồm quyền tự do ngôn luận, phải được tôn trọng trên toàn thế giới và đặc biệt là ở Việt Nam. Điều này được thực hiện chẳng những thông qua sự hỗ trợ cụ thể các cá nhân đang tranh đấu bảo vệ nhân quyền và các tổ chức phi chính phủ, mà còn thông qua việc thiết lập một cuộc đối thoại cởi mở và trực tiếp với các giới hữu trách tại Việt Nam.

Hiệp định thương mại tự do có thể sẽ là công cụ bổ sung cho chúng tôi để theo dõi sự hợp tác chặt chẽ hơn với Việt Nam và nhắm vào sự tiến bộ hơn nữa trong lĩnh vực nhân quyền, đặt nặng trọng tâm vào quyền lao động, minh bạch hơn và mang tính cách pháp quyền, vào sự tương tác chặt chẽ hơn với xã hội dân sự thông qua việc thành lập các nhóm tư vấn nội bộ và việc tạo ra nhiều kênh hợp tác hơn nữa với các cơ quan hữu trách  của Việt Nam .

EU sẽ tiếp tục chú tâm quan sát tình trạng của những người tranh đấu bảo vệ nhân quyền và sẽ quyết liệt lên tiếng trong khuôn khổ giao tiếp với Việt Nam về các trường hợp cá nhân cũng như những lo ngại về quyền tự do ngôn luận.
